1. Introduction & Applicability
Welcome to Heirloom. These Terms & Conditions (“Terms”) govern your use of our website and all pre-orders placed via our Shopify-powered store.
By placing a pre-order or interacting with us, you agree to be bound by these Terms.
Heirloom is operated by RETRO RELICS S.L., and these Terms apply to all transactions unless expressly stated otherwise in writing.
If a provision is found invalid or unenforceable, the remaining clauses remain in full force.
These Terms override any customer-provided conditions. Email and digital communications are deemed valid and binding unless otherwise stated.
2. Offers & Pre-Orders
All listings and product details on our website are invitations to pre-order and do not constitute binding offers.
We reserve the right to correct any errors (including pricing or description mistakes) at any time.
All product descriptions, photos, and designs are the intellectual property of Heirloom and may not be reproduced without permission.
By placing a pre-order, you acknowledge that shipping costs will be calculated and confirmed separately after checkout.
Your pre-order is confirmed once payment is received and we accept it in writing or via email confirmation.
3. Right to Cancel (EU Consumers)
If you are an EU resident purchasing for personal use, you have the right to cancel your pre-order within 14 days of receiving the item — no justification required.
To cancel, notify us in writing within that period and return the item unused, in its original condition and packaging.
We’ll refund the item cost and standard outbound shipping charges. Return shipping costs are your responsibility.
This right of withdrawal does not apply to personalized, modified, or made-to-order pieces.
4. Pricing & Payment
Prices are listed in Euros (€) and exclude VAT, duties, and shipping unless clearly stated otherwise.
Because each pre-order is unique, shipping costs are quoted and charged separately after confirmation.
We require full prepayment for the item before shipping arrangements are made.
Late payments accrue interest at 1.5% per month or the legal maximum. Payments are applied first to fees, then to the oldest balances.
In cases of insolvency or default, all outstanding sums become immediately due. We may request prepayment or other financial guarantees before continuing fulfillment.
5. Delivery Timelines
Estimated delivery times will be provided after your pre-order confirmation.

Spain: 5–7 business days once shipping is confirmed.
We’ll always aim to meet estimated timelines, but please note that delays — including those from couriers or customs — do not justify order cancellation or compensation.
Orders may be shipped separately depending on item size or availability.
6. Shipping, Delivery & Risk
Unless otherwise agreed, shipments are dispatched from our Valencia studio.
Shipping fees, import duties, and taxes are the customer’s responsibility and will be communicated after pre-order confirmation.
If a delivery is refused or unclaimed, you may be charged for storage or re-shipment.
Risk transfers to you once delivery is attempted or the goods are handed to the carrier.
Heirloom reserves the right to withhold delivery until all amounts due (including shipping) are fully settled.
7. Completion of Services
A pre-order is considered fulfilled when:
- We notify you of shipment or readiness for collection;
- You take possession of the goods; or
- You fail to respond within a reasonable time after notification.
8. Responsibilities & Collaboration
We handle all pre-orders with care and may collaborate with trusted logistics or restoration partners.
You agree to provide accurate delivery and contact information. Delays or costs due to incorrect data are your responsibility.
9. Order Modifications
Changes requested after pre-order confirmation may affect timelines or costs.
We are not obliged to accept modifications, and any approved change will be invoiced at current rates.
10. Service Suspension
We may pause or cancel delivery if:
- You breach these Terms;
- We have reasonable doubts about your solvency; or
- Required payments or shipping confirmations are missing.
In such cases, all outstanding payments become immediately due.
Payments may not be withheld due to dissatisfaction or pending claims.
11. Product Information & Authenticity
All items are sold as vintage originals. They may bear marks, wear, or patina consistent with age and use.
Such characteristics are part of each piece’s authenticity and not considered defects.
Descriptions and photos are accurate to the best of our ability, but we make no guarantees as to condition, rarity, or provenance.
Purchasing an item does not transfer intellectual property or reproduction rights.
You are responsible for complying with any applicable import/export or cultural heritage regulations.
12. Complaints & Claims
Please inspect your delivery immediately upon receipt.
Any visible issues must be reported to us in writing within 2 days of delivery.
Minor irregularities due to vintage character are not grounds for complaint.
If a claim is accepted, we may offer repair, replacement, or refund at our discretion.
Claims are void if the item has been used, altered, or repaired.
13. Ownership & Retention of Rights
Ownership remains with Heirloom until full payment — including shipping — is received.
We may reclaim items not fully paid for. Risk transfers to the customer upon dispatch.
We may retain possession of goods or documents until all obligations are fulfilled (right of retention).
14. External Circumstances (Force Majeure)
We are not liable for delays or non-performance resulting from causes beyond our control, such as natural disasters, strikes, supplier failures, or transportation issues.
If disruption lasts longer than six months, either party may terminate the order without penalty.
Heirloom may still invoice for work or goods already completed.
15. Limits on Liability
Our liability is limited to direct, proven damages caused by our fault.
Maximum liability is capped at the item value or €25,000, whichever is lower.
We are not responsible for:

Business interruption or loss of profit;

Consequential or indirect damage;

Improper handling or modification of items;

Use of third-party repair services;

Failure to follow care or installation instructions.
Claims must be submitted within one year of delivery.
16. Cancellation by Heirloom
We may cancel a pre-order without notice if:

You fail to pay or confirm shipping;

You become insolvent or bankrupt;
-
Required guarantees are not provided; or
-
Fulfilling the order becomes unreasonably burdensome due to inaccurate information.
All obligations incurred prior to cancellation remain payable.
17. Confidentiality & Data Protection
Both parties agree to treat non-public information as confidential, even after contract termination.
Exceptions apply for legal disclosure or prior written consent.
We process personal data solely to manage pre-orders and comply with our legal obligations, in line with GDPR and Spanish data protection laws.
18. Legal Framework & Disputes
These Terms are governed by Spanish law.
The CISG (Vienna Sales Convention) does not apply.
All disputes shall be handled by the courts of Valencia, Spain, without prejudice to mandatory consumer rights.
Heirloom may bring claims before another competent court if deemed appropriate.
19. Customer Confirmation
By placing a pre-order, you confirm that:

You understand shipping will be quoted separately and confirmed before dispatch;

You are responsible for any applicable VAT, customs, or import duties.
